The patent battle between Yiguang Electronics Industry Co., Ltd. (hereinafter referred to as "Yiguang") and Nichia Chemical Industry Co., Ltd. (hereinafter referred to as "Japan") was fierce.

Nichia’s attitude is very firm: defending the integrity of patents. The relevant person in charge of Nichia said: "Chinese LED companies must go abroad and must abide by relevant patents."

The goal of Everlight is clear: the patents continue to be invalid, including the Japanese patents, which will expand the marketing of LED lighting products to the global market. Recently, Yiguang announced that it has filed an invalid trial request with the Japanese Patent Office (Intellectual Property Bureau) for JP3503139 patent item 1 held by Nichia. Although the Japan-Asian rapid public relations said that some companies on patent item 1 will seek to modify the patent request to solve. However, this stage of victory still played a strong shot for the development of Yiguang's patent.

On the patent litigation of the global LED phosphor supplier and LED packaging manufacturer Nichia, the new Taiwanese style lawsuit that Yiguang used to have for five years has been solved. After winning the double victory in administrative and civil lawsuits in Taiwan last year, this In 2009, he was given a counter-attack opportunity in Japan, and he also let his peers see the hope of Chinese LED going abroad.

Liu Bangyan, general manager of Everlight, pointed out that Yiguang is deeply gratified by the results. At present, the lighting market layout is mainly in Europe, America and Greater China. It is expected that there will be opportunities to expand the global market in the future.

Want to break the patent bondage

In order to seize the opportunity of lighting, Everlight promoted the global LED lighting business with the “Everlight” and “Zenaro” dual brands.

Affected by the international situation, since the second half of last year, orders from domestic LED companies have begun to decrease. According to industry insiders, from the beginning of the year, it is very common for domestic LED companies to drop orders from Europe and the United States by 30%. In this context, vigorously expanding the huge emerging markets, including Japan, has become the top priority of many leading LED companies in China.

After the 311 earthquake in Japan, LED lighting was accelerated. Everlight hopes to expand the global market in the future, and the Japanese market is the base camp of Nichia. How to break the patent bond and avoid patent risks is the primary problem facing Yiguang. In the process of implementing LED lighting products, Yiguang has filed mutual complaints against patent infringement and patent invalidation in Germany, Taiwan, the United States, Japan, China and Japan.

It is reported that Nichia's 74 basic patents obtained from 1991 to 2001 cover the whole process technology of LED structure, epitaxy, chip and package manufacturing, and related raw materials such as phosphors, and have an absolute monopoly position in the LED field.

Competitors pointed out that Nichia has relied on building patent barriers and patent litigation to prevent other manufacturers from entering the market and competing with them to obtain high monopoly market interests. The Japanese and Japanese sides recently told the Gaogong LED reporter: "Nichia has no plans for patent authorization for other companies including China."

Li Jiahao, director of the China Business Division of Everlight, pointed out that patent barriers do exist. If Chinese LED companies want to go out, they need to break the shackles of patents. “In the process of going out, we realized that patents are the rules of the game.”

To this end, Yiguang established a patent team, the intellectual property department, to carry out the patent layout of the company's product development technology. Li Jiahao revealed that after long-term research and development and production, the company has accumulated more than a thousand LED patents. At the same time, in the process of patent accumulation and the experience of the Japanese and Asian books on the court, the Japanese patents were unclearly questioned, and the Japanese patents were invalidated. The above JP3503139 patent is one of them.

"Nichia patents interfere with the whole world." Liu Bangyan said, "Yiguang may have opened the first shot and will continue the patent war, and will continue to improve the patent strength." Li Jiahao pointed out that Yiguang can call it, it has its own At the bottom of the gas, “100 thousand patents of Yiguang are also a strict patent network, which combines technology and innovation.”
